Clarko wants to bully and intimidate the people who were damaged by his intimidation and bullying.

It seems that Clarkson did not want to give evidence. Rather reminds me of Barilaro wanting his side of the story to be told, but after one day of giving evidence where he was extremely uncomfortable he pulled the mental health card and didn't turn up anymore.

I don't think that Clarko is particularly racist - he has no moral compass when it comes to winning. And if winning means messing up some lives he'll do it. How much ambition is too much?

undoubtedly, Clarko would have been unwilling to "give evidence" without full details of the allegations made to the AFL (not those made in the HFC review) and without a commitment that the complainants could be cross-examined

and, there's overt, direct racism which Clarko/HFC may not be guilty of here, but there's also indirect, systemic racism where you set things up in a way that make it harder if you're not a whitefella, and you should know better (because everyone else does) but you don't really care

This notion of 'cross-examining' the complainants... how was that supposed to work? It's not court. It was an investigative panel. My understanding of how that works is each side talks honestly and openly to the panel, separately, with a view to possible mediation past that. Not sticking someone in a witness box and getting an attack lawyer to grill them. Again, it's not court.
I believe that the demand to be able to 'cross-examine' the complainants was raised in order to intimidate them. Not that it was necessary – right from the beginning they maintained that they didn't trust the AFL to conduct a fair investigation. Whether that was correct or not, it scuppered the investigation even before Clarkson & Co refused to talk.
It's been a giant waste of time and money, with nothing resolved.

The thing is, there are individuals and families that were hurt, damaged and treated in a way that horrifies almost every Australian. They remain that way.

Is it normal for coaches to visit the house of a player en masse for a confrontation with their partner? This is a fact admitted by Burt in the Age. Who the hell does that?

Setting aside what they actually said at the house and the more serious allegations for a moment, they shouldn’t be coaching on that basis alone. It’s misconduct and shows they’re not suitable for the role.

It's disturbing. Also disturbing that he felt, in telling this story, he was cleaning his reputation.

At that early stage of the matter, anyone involved in the issue, complainants and those subject to complaints would as it’s played out, be unwise to talk to the media, anyone in the media, including the ‘trusted’ voice of the ABC.

Tricolour: by way of explanation (not justification), one of the fundamental tenets of our arcane, Eurocentric, male-centric common law legal system is that if any allegations are to be investigated, procedural fairness dictates that the evidence must be able to be robustly tested.

Tone-deaf for the AFL to structure this in a culturally insensitive way when the topic is all about cultural sensitivity.

I also find the ABC journo claims around "public interest" a bit self-serving. Once the story broke, they can't control the sh1tstorm that followed and I'm not convinced the complainants would have understood that, or that they weren't taken advantage of - justice can be done without the need for media glare.

I don't know about justice but I don't think there could have been consequences for these three coaches without media glare. That was the point of wanting the story told, so there would be consequences.

What's the worst anyone in power would do, fine them and force a legally worded apology.

If no other lessons are leant from this, a few well protected football people might now realise that they can be gotten to.

I don't think that's true Shane. Strictly speaking Hird wasn't banned from coaching because it was proven he oversaw a doping program, he was banned for bringing the game into disrepute and conduct unbecoming.

If the allegations made against Clarkson and others were found to be true, isn't their behaviour unbecoming? Hasn't it brought the game into disrepute?

I don't know if a process exists to simultaneously deal with right and wrong and punishment, while at the same time encouraging learning and understanding and dealing with hurt. The Courts have never found a way. Workplaces that I've been part of have never found a way. It's not surprising to me that football clubs and administrators have struggled.
