TOPIC: Patrick Cripps

I actually thought, after reviewing the footage again that there may have been some merit in what they were saying. I think it was only the camera angle that had us first seeing the elbow to the head.
I'm comfortable with him getting off but I'm not comfortable with how this has gone on and it highlights how our tribunal system is garbage.

Nah, that's a rubbish decision, effectively overturning it on procedural points of law rather than the act.

Describe a bump and then describe what Cripps did, they are exactly the same action. Anyone who turns, tucks their arm into their body and leads with their shoulder is bumping someone and even worse, Cripps jumped and hit someone in the head. That's a textbook bump and he KO'd a bloke who's missing at least 2 games now. He should be gone.

Challenging on stupid points of law is not for the AFL. It's not a real court. The AFL lawyer not asking Cripps if it was a bump or not and the rubbish procedural stuff after that doesn't change the fact of what happened and shouldn't see the case overturned. The whole thing is a circus and needs to be overhauled if you can get away with this.
Nathan: When did you get balls?
Simon: I've always had balls you've just never seen them.
Nathan: That's the gayest thing I've ever heard.

I'm not the type to wish ill on any non-slime player, but I'm really struggling with this one.

Let's see what the footy Gods deliver. I hope Carlton get smashed and go on to miss finals by percentage.

The footage I've seen shows Cripps tucking his arm in as he leaps for the 'contest', NOT stretching his arm out for a spoil/mark.
Does it matter whether/not they asked him if he bumped? We can *see* that he tucked his arm in.

That's a bump any day of the week.

1. He bumped a bloke
2. He made contact with said blokes head
3. That bloke is KO'd

If the AFL cares a wit about player welfare - reducing concussion - then a bump making high contact resulting in concussion should be a suspension.

The only point of contention should be whether it's a 1, 2 or 4 week penalty.

The Rioli over-rule set a precedent and this Cripps incident over-rule has exacerbated that precedent.to the nth degree. Virtually anything goes now in similar cases. I'm being facetious but you would have to 'kill' a guy doing this sort of thing to get any penalty! Heaven's above Cripps doesn't even get 1 week and the fellow he KO'd is subbed off and can't play this week. How on earth is that fair? There is an odor of AFL politics in this.

But this was an appeal that determined that there was an error in law at the tribunal hearing AND that the findings of the jury were unreasonable.

Is this really where we want conscious choices of actions that cause concussion to an opposition player to be?

This is really dangerous and utterly wrong.

Whenever I see an outcome like this I blame the Sydney Swans and Andrew Dunkley, who was suspended after the prelim leading to the 1996 Grand Final, successfully sought an injunction in the Supreme Court, played in the Grand Final and then was subsequently suspended for three weeks for his act in the prelim.

The AFL has constructed a tribunal system that mirrors the courts, in part, to prevent that from happening again. A player can’t argue they have been denied natural justice if natural justice is baked into the tribunal process.

But by setting up an independent appeals board, stacked with QCs, you increase the chances of the sorts of procedural defences used by Carlton’s Counsel being successful.

There's no lesson to be learned by players from this appeal decision, only a lesson for the AFL's Counsel that if they are going to ask for a player to be suspended for a bump, they need to establish before the Tribunal that the player indeed bumped.

I thought it was a two-week bump, and there has been a lot of blow-back for the AFL from people who feel the same. I reckon ‘the AFL’ would be fuming with this decision by the independent appeals board – but that’s the price you pay for independence.

I think the AFL is going to have to ask itself which is the greater risk: win-at-all-costs clubs taking them to court every other finals series, or not being able to enforce its own rules to protect players?

What do people expect from an organisation that can’t adjudicate a simple push in the back or throw of the ball, among other things.

Is the way forward to say, if you instigate contact in any non marking contest and hurt the head you are gone.

The Brisbane guy got hurt bad when he shouldn't have.

Can't we work back from that?

We could do with Carlton winning their next two, though. Just saying.

Independent Appeals Board Has anyone asked the question, with full disclosure mandatory, of any allegiances have to any part of the AFL structure? Because it seems to me, that along with the Tribunal, and the MRP, some clubs get a better deal than others.

Hear me out here, if Cripps had have been given the 4 weeks he deserved by the MRP, it would have been very hard for the Tribunal or the IAB to argue down to no suspension, but a 2 week suspension is easily argued down.
