"Fair natural justice" didn't seem to worry Clarkson & co back in the years 2010 to 2016. Why should they be offended by public opinion now?

Clarkson's reputation hasn't been trashed. The reason people accept the story so readily is that it is entirely in character for him.

People haven't changed their opinion on his character. He has a reputation for aggressive and violent behaviour. He also has a reputation for denying that he did anything wrong.

I think, Shane, that is the point that many people, including Clarkson himself, have disregarded.

also quite disingenuous for Clarko to argue the process has been undermined, before it has even started

it's in his interests to attack the process amd avoid having to answer questions about the incident

again, no surprises as it is "playing the man and not the ball"

The process has started.

A purportedly confidential investigation and report, commissioned by the President of a (now) rival club who carries around a Golliwog called Buddy, and who has been incredibly bitter about Clarkson, doesn’t include an interview with the primary alleged perpetrators. It is leaked to a journalist, who spends a fair bit of time re-interviewing the victims but again doesn’t interview the alleged perpetrators, and then gives Clarkson and the rest 24 hours – taken the point of leaving a message during the coaching offseason – to comment on a report that is confidential and that they haven’t seen before he publishes the story.

It’s a minor issue in the scheme of things, but I wouldn’t say the process was great.

Anyone subject to any allegations wants the investigation or inquiry process to be proper.

There are countries which don’t have proper processes to investigate or inquire into matters and we all know how things are done there.

The process was fine. The purpose of the report was to identify problems in the Hawthorn culture and rectify it. Clarkson no longer works for Hawthorn so his side of the story was not relevant. It was not about apportioning blame to individuals, it was about reforming the way the club operates.

Something came up in the process of the report that was troubling and now a specific review is being done into that matter.

No one is on trial, the state is not involved. What is happening is that people are forming opinions and sharing them with each other.

Morgan, I should have been clearer

The review was not intended to be a forum for raising allegations for response and determination.

Now that parts of the review have been leaked in the media, some form of allegation, response and determination process is being prepared to allow him his "day in court", and he's already loudly getting ready to argue that there's no way that process could possibly be fair given what has happened

gives me the impression he's more interested in paying the "best lawyers" to stall this at every turn, rather than interested in getting to the bottom of it all

Clarkson and Fagan may be horrible people but their guilt or otherwise needs to be based only on all facts presented (and to be presented in the future) in this particular instance.
I am concerned that while Clarkson and Fagan are facing the wrath of the public and the media, we are yet to know who their accusers are such that they too can be scrutinized. In cases such as this we need to be fair to both sides regardless of personal feelings and pre-judgements.

What is troubling is that there are strong ‘string them up’ opinions which are not based on the full facts or truth of the matter yet.

No - what's troubling is that nothing appears to be happening and a whole pile of barriers are being erected. This is the time when something should be happening, it's been over a week.

It's not that the victims or the perpetrators are unknown - this isn't some kind of Jimmy Hoffa thing - the AwFL should tell everyone to shut up until they lay down the facts. They have a responsibility to the wider Australian public to get to the bottom of it and to let everyone know what they've found.

Then bring in the lawyers and worry about what to do.

Polly - better to take some time over it and get the process rock solid, then to rush it and have holes in it

Shane, I have no love for Clarkson either. I remember reading a report detailing how he hit a player from behind in an exhibition match in London many years ago and broke his jaw, and apparently has never apologised. On balance, and after consideration of all reports so far, I'm of the opinion that under all the smoke to date there is quite believably some fire. Like many people I'm waiting for all the alleged details to be addressed in the 'fair and just' review Gil is talking about.

But "no one is on trial" Shane? I'd argue that the three alleged perpetrators have been on trial in the published and social media since the story broke.

People are not courts. Social media has no jurisdiction. There's no trial.
