I’m not sure if anyone has knowledge of the details that are associated with Willie Rioli’s urine tampering case but I’m flabbergasted that he is still waiting for a final outcome 14 months after being suspended by the AFL.

Putting aside his guilt or innocence (and my dislike for WCE) this guy’s career, income and future prospects are quickly passing by while he waits for a final decision. Reports in the media today suggest that that he will still have to wait until 2021 before a final decision. There is something seriously wrong with the AFL’s processes if this is an acceptable timeline for a single accusation against one player. All clubs should be concerned as they are equally at risk of being subjected to these processes in the future. An explanation by head office should be a minimum expectation at the moment.

"We are unable to discuss specific details of its intelligence and investigations programme. We are bound by the ASADA Act and ASADA Regulations, the Code, the WADA International Standard for the Protection of Privacy and Personal Information and the Privacy Act. All of these documents contain provisions that regulate when and what we can say about individual matters."
It appears to me, that it has been decided that "Procedural Fairness" is more important than "Natural Justice". That was certainly argued in the Essendon Football Club saga. I agree there is a good argument for that. I certainly do not want a error in procedure creating a loophole that allows drug cheats to beat the system. Providing a fake sample or failing to provide a sample is certainly not a loophole that you would want to make available to drug cheats.
Sun Yang failed to provide a sample in September 2018. It was February 2020 before the World Anti Doping Authority appeal overturned the (incorrect) FINA decision and an 8 year ban was implemented.
Getting the right answer is more important than providing a quick answer. Willi Rioli is no more entitled to get a rapid answer to his outcome than Sun Yang was.

I appreciate the importance of getting all legal aspects nailed, however, if18 months is a “quick answer” then the system is significant flawed regardless of whether you are Rioli or Yang. Also, as I understand it, Sun Yang’s lengthy process also included legal challenges to the initial finding during which time he continued to complete. Has Rioli even reached that step yet?

There are a few things to consider here and I don't know if this is as straightforward as some people think.

1. Rioli was impacted heavily by this situation, if the media reports are correct. To the point where he returned to his family for an extended time. Perhaps his emotional state delayed the process of the investigation. No idea if this happened but it's certainly a possibility.

2. Has there been any behind the scenes legal action delaying things? No idea again but the slime's traditional first response to any kind of action that impacts that outlaw gang is lawyers, guns and money. I wouldn't put it past them judging on past performances.

3. How cooperative has the AFL been with ASADA? Based on past performances, you wouldn't assume that the AFL will cooperate with ASADA other than dealing with the optics. You've only got to look at the extraordinary lengths the AFL went to in order to protect possibly the most extensive drug cheating exercise in AFL history. An effort that was ultimately unsuccessful but did cause several years of delays.

4. Has ASADA finished it's investigation? On the surface, it looks to be a straightforward breach by Rioli that could have been dealt with quickly but perhaps there are other factors delaying the completion of the ASADA probe.

Indeed, if the investigation has been finalised, maybe it's the AFL delaying holding the tribunal hearing so they can do something like a short sentence down to time served or something similar. Again, the absence of ethical conduct by the AFL in the past does not allow you to assume they are responding correctly this time.

Either way, Rioli would be kept up to date on the conduct of the inquiry and is likely to be in a better place than the supporters who are not being told anything. As it happens, he is not playing football, so other teams are not being affected. Leave things alone until something is made public.

“natural justice” and “procedural fairness” are interchangeable terms, like scoring a point or a behind.

there’s no excuse for a decision to take this long. odds on a decision won’t be he end of the matter either... appeals and court challenges will follow for sure if he is banned.

West Coast premiership forward Willie Rioli is likely to have to wait until next year to find out his fate for allegedly tampering with a urine sample last season.

As the 25-year-old’s “agonising” wait drags on, the Eagles are preparing for an AFL tribunal hearing in Melbourne late next month or in early December.

Rioli will be represented by Melbourne-based QC David Grace and the small forward may not attend in person.

West Coast football operations manager Craig Vozzo said a final outcome could take even longer.

“That’s looking like it’s going to be in late November or early December, we’re hoping,” Vozzo told ABC radio.

“We probably won’t get a determination though ’til the New Year, David’s thinking.”

Rioli faces a maximum four-year ban. Any suspension will be backdated to September 2019, when Rioli was dramatically whisked away from the Eagles’ Melbourne hotel two days before their semifinal exit to Geelong to begin a provisional suspension.

Vozzo said Rioli was unlikely to front his tribunal hearing.

“The way it’s been set up on the documentation, you’re able to put in statement of facts, without getting into too much detail, where there’s admissions on certain things,” he said.

“There’s a possibility he may (attend), but we’re thinking it’s probably unlikely.”

The Eagles believe the AFL should consider cutting ties with ASADA and creating their own framework to deal with issues such as Rioli’s.

Collingwood’s Sam Murray had to wait for more than a year before being handed his 18-month doping ban last year.

“This isn’t the first time that a delay of this nature has occurred,” Vozzo said.

“Sam Murray’s was one of the later ones where it was a very similar circumstance, where you’ve got an individual who’s obviously done the wrong thing. But it’s agonising in terms of the wait.

“So whilst it’s not the AFL that are delaying things in an individual circumstance, it’s the system that we’ve signed up for which repetitively creates the same set of facts. In our case Willie.

“So that’s the decision I think that needs to be determined moving forward.”
