And, for their part in that, the Essendon Football Club were penalised, or are being penalised, by the relevant authorities.

The players should not be absolved for their own reckless and negligent behaviour, which was quite a substantial part of the events. Particular for something as facetious is loss of reputation, when he stands to sign a million dollar a year contract.

Dyson Heppell should have known better and he could have acted to avoid breaching the rules.

Being a conscientious objector can be a hard road to travel, but that shouldn't be an excuse not to.
Heppell and others chose a path which they may have felt at the time was of the least resistance ... I think his current objections (ie. suing Essendon) may be a few years too late.

This isn't a 100% single-party culpability scenario: both the players and EFC had responsibility to do the right thing and both failed. The issue that will resolve what the players will get paid will be to what extent the club is responsible.

I think it's pretty well established that the club exerted some pressure to take part in the drugs program. It's a fine line between "encouragement" and "coercion".

(I believe) in this kind of case a court would apportion blame, it's not a black and white situation. I would be extremely surprised if Essendon FC could get a zero contributory negligence result. Unlike the ASADA/WADA prosecution against the players, this case is not really about whether the players were actually given something illegal under WADA rules. It's about harm due to the club's negligence. Losing (or shredding) records is negligent since it prevented the players from clearing their names. There's also a question of whether any of the injected substances were harmful, even if not proscribed by WADA. And whether having unidentifiable substances in your body is good for your psychological well-being. And harm to your reputation, etc.

Essendon are in a tricky situation. Even if they believe in their hearts that they are 100% in the clear, if they don't accept a chunk of liability their relationship with the affected players will be basically untenable. On the other hand, do the maths. A couple of mil times 30 odd players could get consequential. Interesting times.

Rags, it's different: Everyone knows that cars involve risk so you take that on when you buy the car. If the car steering system fails due to a design fault should have been picked up then you have a case.

The Essendon players didn't sign up to be injected with experimental substances with no established clinical indications or safety data, outside of the club's medical supervision. They could expect records to be kept. They could expect the club to be open about what happened. Etc.

I have never seen them named anywhere which is a shame because they should be commended for their courage in not being 'coerced' [read bullied] into participating.

The players themselves have said they were willing particpants.

So where has it been established the club exerted pressure when all of the participants have stated otherwise?

They did sign up to be a part of the program. Those signed consent forms were led in the evidence against them
